Service Complaints Policy & Procedure Introduction Mantrailing UK Ltd aims to provide the highest standards of service and to get things right. The complaints that we receive help us to better understand how we are doing, lessons we can learn and the improvements we can make. We are committed to listening to our service users, acknowledging concerns and putting things right where appropriate. The purpose of this Complaints Policy is to outline how to make a complaint. Who we are? Mantrailing UK Ltd Mantrailing UK Ltd provides a dog sport that teaches dogs and their handlers to find people for fun. We also offer Mantrailing Instructor courses. Employees and instructors are required to adhere to the highest standards of conduct. The code of conduct outlines the purpose, powers and duties of Mantrailing UK Ltd, and the standards required from employees and instructors. The Complaints Procedure provides the framework to resolve any departure from these standards and will be followed when there are any allegations of a breach of the Code of Conduct. The objectives of Mantrailing UK Ltd complaints policy and procedures are to: ensure everyone knows how to make a complaint and how a complaint will be handled ensure that complaints are dealt with consistently, fairly and sensitively within clear time frames provide individuals with a fair and effective way to complain about our work ensure that complaints are monitored to improve our services Mantrailing UK Ltd will ensure that we: listen carefully to complaints and treat complaints as confidential, where possible record, store and manage all complaints accurately and in accordance with the Data Protection Act investigate the complaint fully, objectively and within the stated time frame notify the complainant of the results of the investigation and any right of appeal inform the complainant of any action that will be implemented in order to ensure that there is no re-occurrence Definition of a complaint A complaint is any expression of dissatisfaction by an individual, whether justified or not. An individual may make a complaint if they feel Mantrailing UK Ltd or an employee/instructor has: Failed to provide a service or an acceptable standard of service or made a mistake in the way the service was provided Failed to act in a proper way Provided an unfair service This policy and procedure relate only to complaints received about Mantrailing UK Ltd and its services. What Can I Complain About? You can complain about misconduct. Our staff and members have Codes of Conduct. Please read them if you are thinking of making a complaint about personal misconduct. Some examples of the type of things we can investigate are shown below: The use of racist, sexist or offensive language Failure to declare a potential conflict of interest Bullying or rudeness Unprofessional conduct Sexual harassment You can complain about poor service, which may include concerns about delay, discourtesy or a failure to follow proper procedures. Concern or Complaint It is important to establish the difference between a concern and a complaint. Taking informal concerns seriously at the earliest stage will reduce the likelihood of their developing into formal complaints. If you have any concerns about our work, please contact us as soon as possible, so that we can quickly understand your concerns and try to put things right. If you are not happy with the response to your concern and/or you want to make a formal complaint, please follow the procedure below. Complaints We consider a complaint to be a formal expression of dissatisfaction about any aspect of our service by a person who has been directly involved in the service complained of. We take complaints seriously. We will respond to complaints effectively and deal with them sensitively, fairly and thoroughly. We will not treat any complainant less favourably on the basis of their gender, sexual orientation, race or ethnicity, disability or religion or belief or as a consequence of having made a complaint. When Should I Make My Complaint? A complaint should be made as soon as possible when the issues are still fresh in everyone’s minds; the later the complaint is made, the more difficult it will be to investigate. Formal complaints must be made within 6 months of the event. Reasons we may refuse your complaint If your concern is about the actions or service of a different organisation and we have no involvement in the issue, we will refuse your request and signpost you to the other organisation to complain. There are also situations where we may decide that we won’t look into your complaint further, even though it is a ‘service complaint’. These include: attempts to reopen a previously concluded complaint or to have a complaint reconsidered where we have already given you our final decision where we have already looked into the matter for you under another process anonymous complaints where the time-limit for complaining has passed, and if we think the complaint is unreasonable How to make a Complaint If you wish to make a formal complaint, please use the complaints form if at all possible which can be filled out by clicking HERE . This will depend on the nature of your complaint. It will be helpful if you can summarise your complaint on the form provided and give specific details of the poor service issues you are raising. Please let us know if there is anyone who can provide further relevant evidence relating to your complaint. If you are complaining about a breach of our Codes of Conduct, please try to tell us which parts of the Code you think have been breached. Let us know if you have any particular communication needs, for example if you have a disability which impacts on your ability to communicate or if you require assistance with reading and/or writing. If you need support in making a complaint, we are happy to receive your complaint from: an advice or advocacy agency professionals (such as social workers, community psychiatric nurses, doctors or solicitors) MPs and elected councillors family members or friends. After your advocate has written to us, we will let them know if we need your consent for us to speak to them. The Complaints Process Mantrailing UK Ltd aims to settle the majority of complaints quickly and satisfactorily by the member of staff who provides the service. The complaint may be resolved quickly by way of an apology or by an acceptable explanation to the individual. There are three stages to the complaint’s procedure: Stage One – the complaint Stage Two – investigation Stage Three – appeal You can expect to be treated with courtesy, respect and fairness at all times. We expect that you will also treat our staff dealing with your complaint with the same courtesy, respect and fairness. We will not tolerate threatening, abusive or unreasonable behaviour by any complainant. Stage 1 The complaint will be registered by the Company and an acknowledgement sent back to you or your representative within 7 days of the complaint being received by Mantrailing UK Ltd. A full response to the complaint will be provided by the Company within 20 working days of receipt of the complaint. We are committed to trying to resolve complaints as quickly as possible, therefore, in straightforward complaints it may be possible for the Company to respond sooner. Stage 2 We may need to investigate complaints that are complex or require information to be obtained from third parties. In these types of complaints, we will need to share the details of your complaint with the person or people who you have complained about, so that we can take account of the views of everyone involved. If we also need more information from you, we will let you know. If it is not possible to conclude the full investigation within 20 working days, we will contact you to explain why there is a delay and to give you an estimate of how long it will take us to respond in full. In our final reply we will let you know what we have found and explain how and why we came to our conclusions. The final reply will: Summarise your complaint Address the points you have raised Say what the outcome is including whether your complaint is upheld, not upheld or partly upheld If appropriate, explain what measures are being taken in response to your complaint Give you details about how you can take the matter further if you are not happy with the outcome or the way in which the complaint has been handled. Stage 3 If you are not happy with the response you have received at stage 1 or 2 of the complaints process you can write to our office and ask for a review. A full response to the complaint will be provided within 20 working days of receipt of the complaint. Remedies When we get things wrong, we will act to: accept responsibility and apologise explain what went wrong and why, and put things right by making any changes required learn lessons from mistakes and change policies and practices where proportionate and sensible to do so The action we take to put matters right (i.e., redress) in response to a service complaint can include any combination of the remedies set out in the list below. The general principle we follow is that complainants should, so far as possible, be put in the position they would have been in, had things not gone wrong. The remedy applied needs to be proportionate and appropriate to the failure in service and take into account what redress people seek when they complain. An apology is generally the most appropriate action, but other action may also be necessary in some circumstances. List of remedies A full apology, explaining what happened and/or what went wrong. (An apology is not an acceptance of liability under Section 2 of the Compensation Act 2006) Remedial action, which may include reviewing or changing a decision on the service given to an individual complainant Provide the service required in first instance (immediately, if appropriate) Putting things right (for example a change of procedure to prevent future difficulties of a similar kind, either for the complainant or others) Training or supervising staff; or a combination of both If the complaint is against a self-employed Instructor, we may decide not to use their services. What can I do if I am still not satisfied? Instructor Complaints and Mantrailing UK Ltd’s response Upon investigation of a valid complaint to an individual instructor Mantrailing UK Ltd will enforce one of several responses depending on the severity of the complaint made against them. Mantrailing UK Ltd’s response to the complaint could be as follows: Written warnings for conduct, which will outline the reasons for the warning. A maximum of 3 written warnings in a 12-month period will automatically result in removal from Mantrailing UK Ltd. Upon receiving the third warning the instructor involved will be removed from any association with Mantrailing UK Ltd. Full immediate removal from Mantrailing UK Ltd. This is defined as total removal of and association with Mantrailing UK Ltd and any of this subsequent related companies. Association means using our logos, associated wording, content and anything which the public may relate you to Mantrailing UK Ltd for. Logging and learning from complaints Complaint details, outcomes and actions taken are recorded by us and used for service improvement. We record all complaints we receive and collate data from them to help us understand what types of problems are most prevalent, and how well we are doing to resolve them. We value your feedback and expect to use it to help us to: get things right in the future if we have not done so already become more customer/service user focused be more open and accountable act fairly and proportionately seek continuous improvement We will handle your information so that it is only processed and retained appropriately and legally, in line with data protection legislation. Data protection To process a complaint Mantrailing UK Ltd will hold personal data about the complainant, which the individual provides, and which other people give in response to the complaint. We will hold this data securely and only use it to address the complaint. The identity of the person making the complaint will only be known to those who need to consider the complaint and will not be revealed to other people or made public. However, it may not be possible to preserve confidentiality in some circumstances, for example, where relevant legislation applied or allegations are made which involve the conduct of third parties. Mantrailing UK Ltd will normally destroy complaints files in a secure manner six years after the complaint has been closed.

Terms and Conditions of Mantrailing UK Ltd Terms and Conditions of Mantrailing UK Ltd 1. The terms and conditions are in effect as soon as you sign up for any service offered or merchandise bought from Mantrailing UK Ltd. 2. Signing-up You can sign up through email. No telephone or spoken sign-ups are possible. · You can pay Mantrailing UK Ltd via online booking, bank transfer, cheque or cash. The sign-up means you are bound to these terms and conditions. · After signing up you will receive a confirmation via email. · The payee/client is agreeing to communication via e-mail and therefore storing the e-mail address with Mantrailing UK Ltd · The sign-up is – unless informed through writing – for one team consisting of one person and one dog. Every spectator must sign up and will be charged as such. · The extend of the performance and content of Mantrailing UK Ltd will be as advertised for the specific workshop/course on the website. Travel cost, accommodation and food/drinks are not included, unless you are told otherwise in writing. · Mantrailing UK Ltd is allowed to refuse the participation to anyone without having to give a reason. 3. Payment With signing-up for any services provided by Mantrailing UK Ltd, payment is expected immediately. If not done so, Mantrailing UK Ltd reserves the right to refuse participation in the service you have signed up for. Fees and prices are subject to change without notice. Price at time of booking applies. All services/courses/workshops must be prepaid. No admittance will be allowed unless the course fee has been paid in full. If you wish to pay in cash, please email us for details. 4. Participants It´s “first come first serve”. Mantrailing UK Ltd reserves the right to cancel or postpone any event/service. The number of participants is limited unless listed differently. 5. Cancellation policy The cancellation fee is 100%, unless the space can be otherwise assigned. In case the participant or the participants´ dog becomes ill, so that they cannot take part in the event/service, you have to show a doctors or licensed veterinarian note stating such. You will then be signed up for the next possible course to make up for the one you could not attend. Alternatively, you can find a replacement for you. 6. Participation rules Any participant is required to have a harness and a long lead on their dog. You will not be allowed to participate if you want to put the long lead on a collar and refuse to put a harness on your dog. 7. Behaviour in and around the training areas You have to follow the guidelines of the trainers of Mantrailing UK Ltd. Dogs must be on lead if not worked, unless the trainer gives consent that you can walk your dog off-lead in this area. Please note to always be friendly with pedestrians and traffic participants. You are required to wear a high vis vest or similar, especially when working your dog in areas with a lot of traffic. Mantrailing UK Ltd does not take any responsibility for interference with the law or injuries while participating in the event/service. Your dogs are to be left in the car or securely closed in while we are working other dogs. It is the dog owner’s responsibility to make sure that the car has enough air circulation/flow and water is provided for the dogs’ health and safety. 8. Health of the dogs Only healthy and fully vaccinated (titre tested) dogs are allowed to participate in any event/service that Mantrailing UK Ltd is offering. The participant insures that the dog is free of diseases and fully vaccinated. If a bitch comes or is in season, the event/service organiser has to be informed. If a dog falls ill shortly before or during the event/service, Mantrailing UK Ltd and/or the trainer/organiser is to be informed immediately to discuss further action and prevent a possible disease from spreading. All dogs accepted require to be de-wormed and de-flead regularly. 9. Liability and insurance The participation in any events/services offered by Mantrailing UK Ltd is on your own risk which means the insurance lies with the participant/s themselves. We therefore make you aware, that you have to be insured to be able to participate in any events/services. The participant is fully reliable for any damages/harm done by either themselves, their dogs or the people that came with them. Mantrailing UK Ltd and the organiser/s and trainer/s, instructor/s do not take ANY responsibility for ANY damage/harm done to a person/s or a thing/s (e.g. buildings, cars, dogs, personal belongings etc.). You must be able to prove that your dog is insured if requested to do so. The participant takes the full responsibility for his/her dog/s, even if acting upon instruction of a trainer/s or organiser/s. You are fully responsible for your own and your dogs` actions. Mantrailing UK Ltd cannot be asked to take over any costs for damage or harm done to you or your dog/s. Mantrailing UK Ltd does not take any responsibility in case of injury or death of your dog/s, other animals or yourself or third parties. Mantrailing UK Ltd takes all reasonable precautions within the structure of our training sessions/workshops/courses to avoid injury resulting from dog bites. However, Mantrailing UK Ltd accepts no responsibility for damage or injury resulting from dog bites occurring to clients or their dogs while attending training sessions/seminars/courses/workshops. The Control of Dogs Act 1986 section 21 - "Liability of owner for damage by Dog" applies within our classes/seminars/workshops/trainings/introduction courses and on our premises or public premises (rented from a third party or owned). All instances of accident or injury must be reported to the dog trainer/instructor at the time they occurred. The following items are NOT PERMITTED at any training session/course/seminar/workshop under any circumstances: Electric shock collars, including citronella; any other device that causes discomfort, pain or fear to the dog; Prong or pinch collars; Any equipment that the trainer deems unacceptable. 10. Equipment and clothing With every event/service you will need good, comfortable shoes (hiking boots) and you need to be dressed appropriately for any weather conditions. The participant is responsible to inspect the quality and functionality of the harness, long lead and collar of the dog/s. 11. Length of the event/service The trainer/organiser will determine the length of the event/seminar based on the progress of each participant and their dogs as well as the number of participants and the physical and psychological capability of each dog. The trainer will act in the best interest of the dog and can therefore order a rest for a dog or put a halt on further training sessions. If the participant is late for the event/service, it is their own fault and the trainer/organiser will not stop/pause the event/service because of this. The participant is not eligible to make up for any missed hours/days or get a reduction of cost because of such. 12. Cancellation of a contract or postponing of an event/service by Mantrailing UK Ltd 1. Mantrailing UK Ltd reserves the right to withdraw from a contract without having to obey a timeline/date, especially when a participant does not obey the contract and/or breaks any animal right laws/guidelines. This also applies if the participant puts others and/or their dog/s in danger, or if you and/or your dog is not sufficiently insured. 2. Events/services generally take place in every weather. 3. In case of a change of date, place or time, Mantrailing UK Ltd will inform the participant. 4. Mantrailing UK Ltd reserves the right to postpone or cancel an event/service. · · If the trainer/instructor falls ill or cannot hold the event/service for other reasons, Mantrailing UK Ltd will postpone the event or another head instructor will hold the event. · If the event/service takes place with a smaller group, Mantrailing UK Ltd reserves the right to shorten the time/length of the event/service accordingly. 5. Mantrailing UK Ltd will not refund any costs that are caused by a third party (e.g. flights, hotels, etc.). 13. No guarantee of success Mantrailing UK Ltd will not guarantee any success while or after any event/service. 14. Copyright All the copyright is reserved by Mantrailing UK Ltd. This includes material, videos, pictures, texts, etc.. Information in any form, provided during an event/service, in its original form or modified, can only be used/published with written consent from Mantrailing UK Ltd. Voice recordings and videos of any event/service have to be permitted by Mantrailing UK Ltd. 15. Non-Disclosure agreement Any individual participating in introduction courses, seminars, workshops, instructor courses, trainings or any other services that are offered by any of the Mantrailing UK Ltd instructors (or head-instructor), agrees not to conduct/hold/offer such or similar, to the general public or another business or third parties. This includes Mantrailing introduction courses, Mantrailing seminars, Mantrailing workshops, Mantrailing trainings within two consecutive years after the event. ONLY with written consent of the Mantrailing Head Instructor can this agreement be changed. 16. Pictures and videos Mantrailing UK Ltd reserves the right to take pictures and videos during an event/service. Every participant herewith agrees for these to be published on the website, social media or written form. Participants are not allowed to take pictures, videos, etc. without the consent of the other participants and Mantrailing UK Ltd. Participants are NOT allowed to publish any pictures, videos, voice recordings, text, information gained in any way. The owner allows and consents for their dog to be photographed, videotaped, and/or used in any media or advertising by Mantrailing UK Ltd without prior approval. All such photographs and videos etc. are the property of Mantrailing UK Ltd. 17. General . The instructor will run Mantrailing to the standards and methods of Mantrailing UK Ltd. This will consist of introduction courses and training sessions. . The instructor needs to provide the opportunity for follow on training for clients who have completed introduction courses. . The instructor agrees to the code of conduct. . As an accredited instructor with Mantrailing UK Ltd, the use of any aversive training methods such as an e-collar, prong collar or physical punishment are forbidden. Any use of these methods will lead to an immediate ban from Mantrailing UK Ltd. . Mantrailing UK Ltd does not allow the instructor to offer training for search and rescue operations or individuals, unless qualified by a national/international organisation such as SARDA, NSARDA, BMA, IRO or Lowland Rescue. . Mantrailing UK Ltd is not responsible for any costs incurred by the instructor under Mantrailing UK Ltd. . The Mantrailing UK Ltd head instructor reserves the right to attend any introduction courses and/or training sessions as a spectator without notice to ensure the quality of training. . The instructor must have his/her own public and third party insurance for dog training, as well as professional indemnity. . It is the instructor´s responsibility to ensure the clients´ and client´s dogs´ safety during training. . Mantrailing UK Ltd cannot be held responsible for any injuries, accidents or deaths. . Mantrailing UK Ltd will allow the instructor to sit in on introduction courses, training sessions, seminars and workshops held by head instructors to allow further development. . Mantrailing UK Ltd cannot be held accountable for any failed theoretical - or practical assessments. . The instructor agrees to the terms and conditions of Mantrailing UK Ltd. . The instructor is obligated to show a log sheet of the training and shadowing that is required. This is stated in the log sheet itself. The log sheet must be filled out to the satisfaction of any head instructor. I 18. Code of Conduct . The instructor needs to act in a professional manner at all times. This includes social media. If people can make a connection between private pages/forums and Mantrailing UK Ltd, you are also bound to the code of conduct privately. . The instructor is not allowed to give advice on training matters that he/she is not qualified for. . The instructor agrees to our code of ethics. Integrity. Being straightforward, honest and truthful in all professional and business relationships. Objectivity. Professional competence and due care. Confidentiality. Professional behavior. . If the instructor should not act in the best interest of Mantrailing UK Ltd, they will be informed in writing. . If for any reasons the head instructor and director of Mantrailing UK Ltd, Mrs Lisa Gorenflo, decides that you have not followed the code of conduct or that your behaviour is seen not appropriate for Mantrailing UK Ltd, the contract may be terminated immediately and you will no longer have any involvement or association with Mantrailing UK Ltd. These Terms and Conditions have been authored to assist our clients in getting the most they can from training with Mantrailing UK Ltd. Our terms and conditions may change over time. The terms and conditions apply at time of booking. Revised terms and conditions apply to subsequent bookings. Mantrailing UK Ltd has no liability in respect of the content of other websites that are linked to or from www.mantrailingUK.com and www.mantrailingUK.co.uk .
